McKenna Digital LLC ("Company," "we," "us," or "our") operates the It's Happening mobile application and website (collectively, the "Platform"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Platform.

It's Happening is a real-time multiplayer prediction platform where users compete on prediction accuracy during live events. The Platform operates as a skill-based contest where players create predictions collaboratively, build personal timelines, and vote on outcomes in real-time.

By accessing or using the Platform, you agree to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the Platform.

2. Information We Collect

2.1 Information You Provide

We collect information you voluntarily provide when you register for an account, participate in games, or contact us. This includes:

  • Account Information: Email address, display name, and authentication credentials provided through your chosen sign-in method. If you register using a supported social authentication provider, we receive your name and email address from that provider.
  • Public Profile Information: If you verify your account for public game participation, you will create a unique public username. This username is visible to other players in public games. Any optional profile details you choose to provide, such as a profile photo or bio, are also collected.
  • Age Verification: To participate in public games, you must confirm that you are at least 18 years old. We collect the information necessary to verify this requirement.
  • Game Activity: Predictions you create, votes you cast, timelines you build, games you join or create, and your performance history including scores and leaderboard rankings.
  • User-Generated Content: Prediction text and other content you submit during games. Public game content may be reviewed for compliance with our content guidelines.
  • Communications: Any messages, feedback, or bug reports you send to us directly through the Platform or other channels.

2.2 Information Collected Automatically

When you access the Platform, we automatically collect certain information from your device:

  • Device Information: Device type, operating system, unique device identifiers, and device settings. We generate and store a device identifier to support session reconnection and continuity across app restarts.
  • Location Data: We collect approximate location information derived from your IP address and, where permitted, GPS-based location data from your mobile device. Location data may be used for regulatory compliance purposes, particularly in connection with skill-based contest eligibility by jurisdiction.
  • Usage Data: Pages and features accessed, time spent on the Platform, interaction patterns, referral URLs, and error or crash reports.
  • Log Data: IP address, browser type, access times, and referring website addresses.

2.3 Information from Third Parties

When you authenticate using a supported social authentication provider, we receive limited profile information from that provider as authorized by your privacy settings with that provider. We do not receive your password from these services.

3. How We Use Your Information

  • Platform Operations: To create and manage your account, facilitate gameplay, maintain leaderboards, calculate scores, and enable real-time multiplayer interactions.
  • Account Verification: To verify your eligibility for public game participation, including age verification and public username registration.

  • Content Moderation: To review user-generated content in public games for compliance with our content guidelines, using automated tools and manual review where appropriate.
  • Analytics and Improvement: To understand how users interact with the Platform, identify bugs and performance issues, conduct A/B testing, and improve features and user experience.
  • Error Monitoring: To detect, diagnose, and resolve technical errors, crashes, and performance issues across the Platform.
  • Communications: To send you transactional notifications related to your account and game activity, and to respond to your inquiries and support requests.
  • Safety and Compliance: To detect and prevent fraud, enforce our Terms of Service, verify eligibility for skill-based contests, and comply with applicable legal obligations.

4. Third-Party Services

We work with trusted third-party service providers to operate the Platform. These providers process data on our behalf and in accordance with their own privacy policies. The categories of service providers we use include:

  • Authentication and Identity: We use a third-party identity provider to manage account creation, social sign-in, and session management. This provider receives your email address and profile information necessary to authenticate your account.
  • Cloud Infrastructure and Database: Your game data, predictions, votes, and profile information are stored and processed using cloud-based infrastructure services located in the United States.
  • Analytics: We use analytics services to understand how users interact with the Platform, conduct A/B testing, manage feature availability, and improve user experience. Analytics data may include usage patterns, feature interactions, and device information.
  • Error Monitoring: We use error monitoring services to detect, track, and resolve technical issues, crashes, and performance problems. These services may collect device information, error logs, and usage context to help us diagnose issues.
  • Content Moderation: User-generated content in public games may be reviewed using automated moderation tools to ensure compliance with our content guidelines.

  • Public Game Data: Your public username (not your real name or email), predictions, votes, and performance scores are visible to other players in public games you participate in. In private games, your display name is visible to other participants. Leaderboard rankings are publicly visible.
  • Service Providers: We share data with the third-party service providers listed in Section 4, strictly for the purposes described.
  • Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request.
  • Safety: We may disclose information to protect the rights, property, or safety of McKenna Digital LLC, our users, or the public.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. You will be notified of any such change.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the Platform's services. Specifically:

  • Account Data: Retained for the duration of your account's existence. You may request deletion at any time (see Section 8).
  • Game Activity: Prediction and voting history is retained to maintain leaderboard integrity, historical game records, and performance statistics.
  • Analytics Data: Aggregated and anonymized analytics data may be retained indefinitely for product improvement purposes.
  • Device Identifiers: Retained while your account is active to support session reconnection. Deleted upon account deletion.

After account deletion, we may retain certain information in anonymized or aggregated form where it is necessary for legitimate business purposes or legal compliance.

7. Data Security

We implement appropriate technical and organizational measures to protect your personal information, including:

  • All data transmitted between your device and our servers is encrypted using TLS (Transport Layer Security).
  • Authentication tokens are managed securely through our identity provider with automatic expiration and refresh.
  • Database access is controlled through authenticated server-side functions with role-based permissions.
  • We do not store passwords directly; authentication is handled by our identity provider or delegated to social sign-in providers.

While we strive to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but are committed to following industry best practices.

8. Your Rights and Choices

8.1 Account Management

  • Access: You may access and review your account information through the Platform's settings.
  • Update: You may update your profile information, username, and display name at any time through the Platform.
  • Delete: You may request deletion of your account by contacting us at the email address listed in Section 12. Upon deletion, we will remove your personal information, though anonymized game history may be retained for leaderboard integrity.

8.2 Analytics and Tracking

  • You may opt out of analytics tracking through the Platform's privacy settings where available.
  • You may disable location services for the app through your device's operating system settings. Note that disabling location services may affect your eligibility for certain skill-based contest features that require geographic verification.

8.3 Communications

  • You may opt out of non-essential communications by following the unsubscribe instructions in any email we send.
  • Transactional communications related to your account and active game participation are necessary for Platform operation and cannot be opted out of while your account is active.

8.4 State-Specific Rights

Depending on your state of residence, you may have additional rights under applicable privacy laws, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of certain data processing activities. To exercise any of these rights, please contact us using the information in Section 12.

9. Children's Privacy

The Platform is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children under 18. The skill-based contest features of the Platform are restricted to users who are at least 18 years old. Access to public games requires age verification.

If we become aware that we have collected personal information from a child under 18, we will take steps to promptly delete such information. If you believe that a child under 18 has provided us with personal information, please contact us at the email address listed in Section 12.

10. International Users

The Platform is operated from the United States. If you are accessing the Platform from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using the Platform, you consent to the transfer of your information to the United States.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make changes, we will update the "Effective Date" at the top of this policy and, for material changes, notify you through the Platform or via email. Your continued use of the Platform after any changes indicates your acceptance of the updated Privacy Policy.
